In accordance with the Federal Law on the Protection of Personal Data in Possession of Private Parties (the Law) Sigma Foods, S.A.B. de C.V. and/or Sigma Alimentos Corporativo, S.A. de C.V., its affiliates and subsidiaries (hereinafter “Sigma Foods”) domiciled at Av. Gómez Morín 1111 Sur, Colonia Carrizalejo, San Pedro Garza García, Nuevo León, Mexico, C.P. 66254, is responsible for the processing of your personal data.

The collection of personal data is carried out in accordance with the provisions of Article 6 of the Law, emphasizing that the collection of data and its processing will be carried out in a lawful manner, with due consent, with proportionality and responsibility.

II.  Personal Data

For the purposes of this Privacy Notice, Personal Data shall be understood as any information concerning an identified or identifiable natural person, directly or indirectly. Likewise, Sensitive Personal Data is considered to be those that by their nature affect the most intimate sphere of the owner, or whose improper use may give rise to discrimination, which may reveal aspects such as racial or ethnic origin, state of health, genetic information, religious, philosophical and moral beliefs or political opinions.

A.  Employee Candidates

Thus, for the provision of our services, the personal data that Sigma Foods requires to obtain if the owner is a candidate for employee are:

• Personal identification and contact data such as address, telephone, email, federal taxpayer registry (RFC)
• Physical characteristics such as photography or video, if necessary.
• Academic Data
• Asset Data

B.  Employees

Similarly, the Personal Data that Sigma Foods requires to obtain if the owner is an EMPLOYEE are:

• Personal identification and contact data such as address, telephone, email, federal taxpayer registry (RFC)
• Physical characteristics such as photography or video, if necessary.
• Academic Data
• Employment Data
• Asset Data

Similarly, the sensitive personal data that will be processed for these purposes will only be when strictly necessary for the fulfillment of obligations derived from the recruitment and selection process, always with the express consent of the owner in accordance with Article 8 of the Law. This data can be:

• Ideological personal data
• Personal health data

C.  Supplier

Likewise, the Personal Data that Sigma Foods requires to obtain if the owner is a SUPPLIER are:

• Personal identification and contact data such as address, telephone, email, federal taxpayer registry (RFC)
• Employment Data
• Asset Data

D.  Visitors

The Personal Data that Sigma Foods may collect from individuals who enter or visit their corporate offices, plants, distribution centers, branches, or any other facility includes:

• Identification data, such as full name, signature, photograph, official identification and company or organization of origin.
• Contact details, such as email and telephone number.
• Information related to the reason for the visit, person or area to be visited, date and time of entry and exit.
• Images and recordings obtained through video surveillance systems located on the premises.

E.  Customers

The Personal Data that Sigma Foods requires to obtain when the owner is a CUSTOMER are the following:

• Identification data (full name, company name, trade name, RFC, signature).
• Contact details (address, email, landline and/or mobile phone).
• Billing and tax data.
• Bank and financial details are necessary for the management of payments, returns or refunds, where applicable.
• Commercial information related to the acquisition of products or services, transaction history, commercial preferences and response to requests.

F.  Promotion Participants and Digital Users

The Personal Data that Sigma Foods may collect from participants in promotions, contests, sweepstakes, dynamics, activations, advertising campaigns, as well as from users who interact with our websites, applications, social networks and other digital platforms, include:

• Identification data, such as full name, age, date of birth, and image.
• Contact details, such as email, home address and telephone number.
• Information related to participation in promotions, contests, sweepstakes or dynamics.
• Browsing and using data on digital platforms, such as IP address, browser type, operating systems, online identifiers, cookies and similar technologies, in accordance with applicable regulations.
• Information is contained in contact forms, registrations, surveys, or any other means of digital interaction.

III.  Means of collecting Personal Data

The Personal Data necessary to comply with the purposes expressed in this Privacy Notice may be collected, among other ways, by being provided directly by the owner of the data, through electronic means and online services, such as the Sigma Foods website or emails, as well as any other source of information permitted by law.

IV.  Purposes of data processing

A.  Employee Candidate

The Personal Data obtained by Sigma Foods, if the owner is a candidate for employment, will be used for the following purposes:

• Identification, to manage talent recruitment, selection and evaluation processes.
• To allow your participation in our recruitment and selection processes.
• Communication with the candidate regarding the progress of their application, coordinate interviews, evaluations or corresponding tests, verify the authenticity of the information provided and keep the candidate’s information updated.

B.  Employee

The Personal Data obtained by Sigma Foods, if the owner is an employee, will be used for the following purposes:

• Identification, for the administration, operation and compliance of the employment relationship.
• The Contact Data will be used for internal communication purposes related to the work interaction.
• Evaluation, promotion and monitoring of professional development.
• Comply with the obligations and labor benefits agreed with the company.
• Prevention of occupational risks.

C.  Supplier

The Personal Data obtained by Sigma Foods, if the owner is a supplier, will be used for the following purposes:

• Identification, to carry out the commercial relationship.
• Communication, for operational coordination and contractual compliance in commercial relationships.
• Evaluation
• Compliance with the legal obligations of the Client-Supplier relationship.
• Grant access to our facilities to provide the agreed service.
• Prevention of occupational risks

D.  Visitors

The Personal Data obtained by Sigma Foods, if the owner is a visitor, will be used for the following purposes:

• Identification, to comply with safety and risk control obligations.
• Grant access to our facilities

E.  Customers

The Personal Data collected from customers will be processed for the following primary purposes:

• Identify and register the customer in Sigma Foods’ internal systems.
• Manage the commercial and contractual relationship.
• Process orders, deliveries, billing, collections, returns, and clarifications.
• To attend to queries, requests, complaints or requirements related to the products and services offered.
• Comply with legal, regulatory, fiscal and contractual obligations.

F.  Promotion Participants and Digital Users

Personal Data will be processed for the following primary purposes:

• Manage registration and participation in promotions, contests, raffles, dynamics, activations and advertising campaigns.
• Verify compliance with the participation requirements and, where appropriate, the delivery of prizes, incentives or benefits.
• Contact participants for notifications related to their participation.
• Respond to requests, queries, comments or requirements made through digital means.
• To administer, operate, and improve our websites, applications, and digital platforms.
• Comply with applicable legal and regulatory obligations.

In no case will Sigma Foods give a different use to any Personal Data collected, unless there is a change in this Privacy Notice, which will be communicated to the owner in due course and through the mechanisms stipulated in this Privacy Notice.

V.  Choices and Means to Limit the Use or Disclosure of Personal Data

If the owner of the Personal Data wishes to limit the use or disclosure of their Personal Data, they must contact Sigma Foods’ legal department of contracts and litigation, located at the address, who is responsible for processing this type of request. In such a situation, the responsible party will inform you of the procedure established by Sigma Foods so that the owner can limit the use or disclosure of personal data.

VI.  Consent of the Owner

In terms of Article 16 of the Law, the owner declares that this Privacy Notice has been made known to him by Sigma Foods, that he has read and understood all the above regarding the processing of his Personal Data. If no opposition is expressed, the owner is giving his/her consent for the processing of his/her Personal Data under the terms of this Privacy Notice.

Likewise, Sigma Foods does not process Personal Property and Financial Data, except in the cases established in Article 7 of the Law. Similarly, in the event that Sigma Foods requires the processing of Sensitive Personal Data, the owner, in accordance with Article 8 of the Law, grants his/her express written consent for its processing, through his/her handwritten signature, electronic signature, or any authentication mechanism established for this purpose by Sigma Foods, as appropriate.

In terms of Article 9 of the Law, Sigma Foods does not require the consent of the owners to process their personal data in the following cases:

1. A legal provision so provides.
2. Personal data contained in publicly accessible sources.
3. Personal data is subject to a prior dissociation procedure.
4. Personal data are required to exercise a right or comply with obligations arising from a legal relationship between the owner and the controller.
5. There is an emergency that could potentially harm an individual in his person or property.
6. Personal data are essential to carry out a treatment for medical care, prevention, diagnosis, the provision of health care, or the management of health services, while the owner is not in a position to grant consent, under the terms established by the General Health Law and other applicable legal provisions and that said data processing is carried out by a person subject to professional secrecy or equivalent obligation, or
7. There is a court order, resolution or well-founded and reasoned mandate from a competent authority.

VII.  Data Transfer

Sigma Foods undertakes not to transfer Personal Data to third parties, except for the exceptions provided for in Article 36 of the Law, and where appropriate, the aforementioned transfers will be carried out in compliance with the conditions specified therein. The exceptions contained in the article are the following:

1. When the transfer is provided for in a law or treaty to which Mexico is a party.
2. When the transfer is necessary for medical prevention or diagnosis, the provision of health care, medical treatment, or the management of health services.
3. When the transfer is made to holding companies, subsidiaries, or affiliates under the common control of the responsible party, or to a parent company or to any company of the same group as the responsible party that operates under the same internal processes and policies;
4. When the transfer is necessary by virtue of a contract entered into or to be entered into in the interest of the owner, by the responsible party and a third party;
5. When the transfer is necessary or legally required for the safeguarding of public interest, or for the procurement or administration of justice;
6. When the transfer is necessary for the recognition, exercise or defence of a right in a judicial proceeding, and
7. When the transfer is necessary for the maintenance or fulfilment of a legal relationship between the controller and the owner.

VIII.  ARCO Rights

In accordance with Article 21 of the Law, the owners of Personal Data may exercise the rights of access, rectification, cancellation and opposition (ARCO) to the processing of their personal data against Sigma Foods.

To consult the procedure for exercising the rights mentioned in the previous paragraph, the owner must contact the following email address: vihernandezb@sigma-alimentos.com in order to exercise your rights, or you may go to Sigma Foods’ address and submit a letter addressed to Sigma Foods’ legal department of contracts and litigation, which is responsible for this type of request, to express your refusal to the processing and transfer of your Personal Data, as well as to revoke your consent to the processing and the limitation of the use or disclosure of the same.

For the application to be accepted by Sigma Foods, it must be made in accordance with the provisions of Article 28 of the Law, in terms of containing and accompanying the following:

1. The name of the owner and his or her address or any other means of receiving notifications;
2. Documents that prove the identity of the holder or, where appropriate, the personality and identity of his representative;
3. The clear and precise description of the personal data with respect to which one of the ARCO rights is sought to be exercised, except in the case of the right of access;
4. The description of the ARCO right that is intended to be exercised, or what the holder requests, and
5. Any other element or document that facilitates the location of personal data.

Sigma Foods will respond to the request, in accordance with the provisions of the Law, within a maximum period of 20 (twenty) days, counted from the date on which it was received for the exercise of the ARCO rights, to indicate the determination adopted, so that, if appropriate, it is made effective within fifteen days following the date on which the response is communicated. Likewise, the aforementioned periods may be extended only once for an equal period, provided that the circumstances of the case justify it.

Thus, the response to these requests will be delivered to the owner of the Personal Data by issuing simple copies or by electronic documents, according to the specific case.

IX.  Changes to this Privacy Notice

Sigma Foods reserves the right to make any modifications it deems pertinent to this Privacy Notice, in order to adapt, update, improve it, or comply with new legal provisions.
