  • ARCO Rights and Withdrawal of Consent Data owners have the right to access, rectify, cancel and oppose the processing of their Personal Data (“ARCO Rights”), as well as to withdraw consent previously granted. To exercise these rights, the data owner must visit Sigma Foods’ address and submit a written request to the Contracts and Litigation Legal Department specifying which right they wish to exercise and under what terms. The request must contain the elements established in Article 29 of the Federal Law.

  • Data Transfer Sigma Foods undertakes not to transfer Personal Data to third parties, except for the cases provided under Article 37 of the Federal Law, in which case the transfers will comply with the conditions set forth therein. These exceptions include:
    • When the transfer is permitted under any Law or Treaty to which Mexico is a party

The collection of personal data is carried out in accordance with the provisions of Article 6 of the Law, emphasizing that the collection of data and its processing will be carried out in a lawful manner, with due consent, with proportionality and responsibility.

V.  Choices and Means to Limit the Use or Disclosure of Personal Data

If the owner of the Personal Data wishes to limit the use or disclosure of their Personal Data, they must contact Sigma Foods’ legal department of contracts and litigation, located at the address, who is responsible for processing this type of request. In such a situation, the responsible party will inform you of the procedure established by Sigma Foods so that the owner can limit the use or disclosure of personal data.

VII.  Data Transfer

Sigma Foods undertakes not to transfer Personal Data to third parties, except for the exceptions provided for in Article 36 of the Law, and where appropriate, the aforementioned transfers will be carried out in compliance with the conditions specified therein. The exceptions contained in the article are the following:

  1. When the transfer is provided for in a law or treaty to which Mexico is a party.
  2. When the transfer is necessary for medical prevention or diagnosis, the provision of health care, medical treatment, or the management of health services.
  3. When the transfer is made to holding companies, subsidiaries, or affiliates under the common control of the responsible party, or to a parent company or to any company of the same group as the responsible party that operates under the same internal processes and policies;
  4. When the transfer is necessary by virtue of a contract entered into or to be entered into in the interest of the owner, by the responsible party and a third party;
  5. When the transfer is necessary or legally required for the safeguarding of public interest, or for the procurement or administration of justice;
  6. When the transfer is necessary for the recognition, exercise or defence of a right in a judicial proceeding, and
  7. When the transfer is necessary for the maintenance or fulfilment of a legal relationship between the controller and the owner.

VIII.  ARCO Rights

In accordance with Article 21 of the Law, the owners of Personal Data may exercise the rights of access, rectification, cancellation and opposition (ARCO) to the processing of their personal data against Sigma Foods.

To consult the procedure for exercising the rights mentioned in the previous paragraph, the owner must contact the following email address: vihernandezb@sigma-alimentos.com in order to exercise your rights, or you may go to Sigma Foods’ address and submit a letter addressed to Sigma Foods’ legal department of contracts and litigation, which is responsible for this type of request, to express your refusal to the processing and transfer of your Personal Data, as well as to revoke your consent to the processing and the limitation of the use or disclosure of the same.

For the application to be accepted by Sigma Foods, it must be made in accordance with the provisions of Article 28 of the Law, in terms of containing and accompanying the following:

  1. The name of the owner and his or her address or any other means of receiving notifications;
  2. Documents that prove the identity of the holder or, where appropriate, the personality and identity of his representative;
  3. The clear and precise description of the personal data with respect to which one of the ARCO rights is sought to be exercised, except in the case of the right of access;
  4. The description of the ARCO right that is intended to be exercised, or what the holder requests, and
  5. Any other element or document that facilitates the location of personal data.

Sigma Foods will respond to the request, in accordance with the provisions of the Law, within a maximum period of 20 (twenty) days, counted from the date on which it was received for the exercise of the ARCO rights, to indicate the determination adopted, so that, if appropriate, it is made effective within fifteen days following the date on which the response is communicated. Likewise, the aforementioned periods may be extended only once for an equal period, provided that the circumstances of the case justify it.

Thus, the response to these requests will be delivered to the owner of the Personal Data by issuing simple copies or by electronic documents, according to the specific case.

IX.  Changes to this Privacy Notice

Sigma Foods reserves the right to make any modifications it deems pertinent to this Privacy Notice, in order to adapt, update, improve it, or comply with new legal provisions.
